Condiciones generales de venta

1. Purpose

These T&C govern the services provided by BoostMyPresta: web creation, redesign, maintenance and support services, as well as online-subscribed maintenance plans.

2. Acceptance

Any order (one-off or subscription) implies unconditional acceptance of these T&C. The Client acknowledges having read and understood them.

3. One-off services

One-off services (creation, redesign, troubleshooting…) are subject to a prior quote detailing: deliverables, schedule, payment terms and any limitations.

A signed quote acts as a purchase order. A 40% deposit is generally requested on signature, the balance on delivery.

4. Maintenance subscriptions

Maintenance subscriptions (Essential, Performance, Premium) are subscribed online via Stripe. They are:

  • Billed monthly or yearly by automatic direct debit
  • Commitment-free — cancellable at any time
  • Activated upon first payment validation

5. Cancellation

The Client can cancel their subscription at any time via their Stripe account or by emailing [email protected]. Cancellation takes effect at the end of the current period (no prorated refund).

6. Right of withdrawal

For subscriptions purchased by consumers (non-professionals), a 14-day right of withdrawal applies in accordance with French consumer law, unless the service has started at the express request of the Client.

7. Pricing and payment

Prices are stated in euros (€), excluding taxes. Applicable VAT depends on the tax status of the Client and the provider. Payment is secured by Stripe (PCI-DSS compliant).

8. Obligations

BoostMyPresta undertakes to perform the services with diligence and professionalism (best-efforts obligation). The Client undertakes to provide the access, content and information necessary for the proper execution of the services.

9. Ownership

After full payment, the Client becomes the owner of the code and deliverables produced, except for third-party licensed elements (paid modules, themes, etc.) which remain subject to their conditions.

10. Liability

BoostMyPresta's liability can only be engaged in case of proven fault, and is limited to the amount of services billed over the last 12 months.

11. Disputes

Any dispute will be subject to French law. Failing an amicable agreement, the competent courts are those of the jurisdiction of BoostMyPresta's registered office.
